As of October 1, 2021, the new Law No. 21,327 comes into force, related to the modernization of the Labor Directorate through the incorporation of new technologies and the digitization of procedures, improve the regulation on hiring and remuneration and promote new forms and criteria of control.
Law No. 21,327 incorporates new regulations and modifications to the Labor Code, where among its greatest requirements is the registration of employment contracts electronically by the employer, within a period of 15 days after their respective conclusion.
Regarding the employment contracts entered into prior to the date of entry into force of the Law, the employer must compulsorily comply with the aforementioned registry within a period of one year from the publication of the Law.
By regulation of the Ministry of Labor and Social Security, the data and documentation of the employees must be kept in the aforementioned electronic site of the Labor Directorate, where the registry of such data will be implemented and updated. The Law indicates that after such information is incorporated into the electronic labor registry, employers will be able to centralize such documents in a single place, which must be previously informed to the Labor Directorate. In this way, the DT will have the power to electronically access all the mandatory labor and social security documentation of employees and companies.
